In 1998, Idaho adopted the Patient Freedom of Information law, chapter 45 of title 54, which, no later than January, 2000,
will require public disclosure of information about various types of health care
practitioners.
Which
Practitioners Are Subject to the Law?
Physicians and surgeons, podiatrists, chiropractors, dentists, nurse
practitioners, certified nurse midwives, clinical nurse specialists, certified registered nurse anesthetists, optometric physicians,
physicians' assistants, physical therapists and psychologists are subject to the law.
What
Information Will Be Made Public Under the Law?
Public Information includes:
- Education.
- Any Specialty in which the practitioner has been certified.
- Criminal convictions for felonies or other crimes of moral
turpitude within the most recent 10 years.
- Final disciplinary actions by professional licensing/registration boards
within the most recent 10 years.
- Hospital disciplinary actions within the most recent 10 years.
- Whether the practitioner has malpractice insurance;
- Malpractice court judgments and
arbitration awards in which a
payment was awarded to a complaining party during the most recent ten years.
- Settlements of malpractice claims if the practitioner has had 5 or more
settlements in the most recent 5 years of continuous practice each of which was $50,000 or
more or has had more than 10 such settlements in such 5 year period regardless of amount.
If either condition is met, all malpractice settlements during the most recent 5 years of
continuous practice must be disclosed, except for settlements where the only result is an
adjustment in the practitioner's fee.
- Appointments to medical/professional school faculties.
- The practitioner's primary hospital affiliation;
- Office Location.
- Whether the practitioner participates in Medicare and Medicaid.
- The practitioner's ownership interests in other health facilities or medical suppliers to which
the practitioner's patients may be referred.
What is the Source
of the Information Which will Be Disclosed Under the Law?
All of the information will be reported by the health care practitioner. It
will not be independently verified by the State of Idaho.
Where Can The Public
Obtain Profiles?
Health care practitioners must submit the information to the Board
responsible for granting them a professional license or registration. The information must
be provided at the time the initial license or registration and any renewal is applied
for. The Board is required to create a profile containing the information submitted for
each health care practitioner. Consumers can Obtain
Profile Information Online or request a copy of the profile
from the State of Idaho by phone at 1-888-622-3855
(toll free) or directly from
the health care practitioner, who is required to maintain their profile at their office,
or from the appropriate state licensing/registration board.
What Are the
Penalties for Noncompliance with the Law?
The licensing/registration board may fine practitioners who do not comply
with the law up to $50/day. The board may also take other disciplinary action which it
deems appropriate except that it may NOT revoke, suspend, refuse to issue or refuse to renew a license or
registration solely because of a violation of this statute.
